1. Who these terms cover
These Terms of Use (the "Terms") apply to you as an end user when you interact with technology provided by VoiceBit Inc. ("VoiceBit," "we," "us"), 128 King St, San Francisco, CA 94107. That includes when you:
- call a restaurant whose phone line is answered by the VoiceBit AI ordering assistant;
- place an order on an online ordering website that VoiceBit builds and hosts for a restaurant;
- receive text messages from VoiceBit on a restaurant's behalf, such as a payment link or order and delivery updates; or
- use a payment or order-tracking link we send you.
By using any of these, you agree to these Terms. If you do not agree, please place your order in person or ask to speak with restaurant staff.
2. VoiceBit provides technology; the restaurant sells the food
The restaurant, not VoiceBit, is the seller and is responsible for the food, its preparation, allergens, pricing, taxes, promotions, refunds, and its own service. VoiceBit provides the software that takes the order and passes it to the restaurant. Any dispute about an order, its contents, quality, or price is between you and the restaurant, and the restaurant's own terms and policies apply to the sale.
3. Calls are recorded
When you call a restaurant line answered by VoiceBit, the call is recorded and transcribed. You are notified of this at the start of the call. Recordings and transcripts are used to take and fulfil your order, to check the accuracy of what the AI heard, to resolve disputes, and to improve the service. If you do not wish to be recorded, hang up and contact the restaurant by another method, or ask to be transferred to a person. How recordings are handled is described in our Privacy Policy.
4. You are talking to an automated assistant
The ordering assistant is automated. It is designed to take orders accurately and to hand off to a person when needed, but like any system it can mishear or misunderstand. Always check the order confirmation you receive by text or on screen, and contact the restaurant promptly if anything is wrong. You can ask to be transferred to a person at any point during the call.
5. Text messages
If you provide your mobile number while ordering, you agree that VoiceBit may text you on the restaurant's behalf about that order, including a payment link and order and delivery status updates. These are transactional messages tied to your order.
- Message frequency varies by order. Message and data rates may apply from your carrier.
- Reply STOP to any message to opt out, or HELP for help. Opting out may prevent us from sending you a payment link or delivery updates for future orders.
- We do not sell your phone number, and we do not use it for third-party marketing.
6. Payment
VoiceBit never takes card numbers over the phone. If payment is required before pickup or delivery, you receive a secure link and enter your card details on a payment page operated by our payment processor. VoiceBit does not store your full card number. Prices, taxes, delivery fees, service fees, and tips are set by the restaurant and shown to you before you pay.
7. Delivery
Where a restaurant offers delivery, it may be fulfilled by the restaurant's own drivers or by a third-party delivery network. If a third-party driver delivers your order, the delivery is performed by that provider, and your delivery address and contact details are shared with them so they can complete it. Delivery times are estimates.
8. Acceptable use
You agree not to use the service to place fraudulent or knowingly false orders, to harass or abuse restaurant staff or drivers, to attempt to disrupt, probe, or reverse-engineer the service, or to use it for anything unlawful. A restaurant may decline or block orders at its discretion.
9. Intellectual property
The VoiceBit software, websites, and brand are owned by VoiceBit and its licensors. These Terms do not grant you any right to use them beyond ordering as an ordinary customer.
10. Disclaimers
To the maximum extent permitted by law, the service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that an automated assistant will capture every order perfectly. VoiceBit makes no representation about the food itself, including its safety, quality, ingredients, or allergen content; those are the restaurant's responsibility. If you have a food allergy or dietary restriction, confirm it directly with the restaurant.
11. Limitation of liability
To the maximum extent permitted by law, VoiceBit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or relating to your use of the service. VoiceBit's total liability to you for any claim relating to an order will not exceed the greater of the amount you paid for that order or fifty US dollars ($50). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Changes
We may update these Terms from time to time. The updated version takes effect when posted, and the date at the top shows when it last changed. Continued use of the service after that means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in San Francisco County, California will have exclusive jurisdiction over any dispute, and you and VoiceBit consent to that jurisdiction.
